Legal Disclaimer for Chip Tuning – Euro Car Electronics & ECU Tunes

1. Acknowledgment of Risk & Understanding of ECU Tuning

By proceeding with ECU tuning services provided by Euro Car Electronics & ECU Tunes, the client acknowledges that:

  • Chip tuning and ECU remapping involve modifications to the factory software of a vehicle's engine management system.
  • These modifications can result in changes to engine performance, fuel economy, emissions, and overall vehicle behavior.
  • Tuning a vehicle may void manufacturer warranties and affect insurance coverage. It is the client’s responsibility to verify their obligations with their vehicle manufacturer, insurer, and any relevant authorities before proceeding with the service.

2. Exclusion of Liability

To the maximum extent permitted by Australian Consumer Law (ACL) and any other relevant laws, Euro Car Electronics & ECU Tunes:

  • Are not responsible for any mechanical, electrical, or software failures that may arise following an ECU tune.
  • Shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from modifications, including but not limited to:
    • Engine failure, gearbox failure, turbocharger or fuel system damage, drivetrain wear, overheating, clutch slippage, increased emissions, and fuel consumption changes.
    • Issues with factory safety features, sensors, diagnostic systems, or error codes that may arise due to ECU tuning.
    • Complications with subsequent vehicle software updates, dealer servicing, or warranty claims.
  • Are not liable for any fines, defects, or legal consequences related to compliance with Australian road laws, emissions regulations, or vehicle safety standards following a tune. The client assumes full responsibility for ensuring compliance with ADR (Australian Design Rules), state laws, and roadworthiness requirements.

3. Vehicle Condition & Pre-Tune Requirements

The client acknowledges that:

  • ECU tuning is performed on an “as is” basis, meaning any pre-existing mechanical faults or weaknesses may become more apparent after tuning.
  • A full mechanical inspection is required prior to tuning to ensure the vehicle is in a roadworthy and mechanically sound condition.
  • Euro Car Electronics & ECU Tunes will not be held liable for any failures that result from existing wear, defects, or underlying mechanical/electrical issues.
  • Any dyno testing, road testing, or modifications requested by the client are done at their own risk.

4. No Guarantees or Refunds for Performance Expectations

  • While every effort is made to ensure a safe and effective tune, Euro Car Electronics & ECU Tunes do not guarantee specific performance outcomes, including horsepower, torque gains, fuel efficiency, or drivability improvements.
  • Refunds or re-tuning services will not be provided if the client is dissatisfied with the tune due to subjective performance expectations.
  • If any tuning-related issues arise, the client must notify Euro Car Electronics & ECU Tunes within 14 days, after which further tuning adjustments may incur additional costs.

5. Acceptance of Terms

By proceeding with ECU tuning, the client:

  1. Confirms they have read and understood the risks, limitations, and exclusions of liability outlined in this disclaimer.
  2. Acknowledges that Euro Car Electronics & ECU Tunes shall not be liable for any damage, defects, or legal consequences resulting from the tune.
  3. Accepts full responsibility for their vehicle post-tune, including all ongoing maintenance, compliance obligations, and associated risks.

This disclaimer is compliant with Australian Consumer Law (ACL) and does not limit any non-excludable consumer guarantees under the Competition and Consumer Act 2010 (Cth).
